Three Types of Burglary Charges in New York
There are three different levels of burglary charges:
Third Degree Burglary – This is a class D felony, the least serious. This occurs when
it is alleged that the accused entered or remained in a building in order
to commit a crime. If convicted, the offender can be sentenced up to 7
years in state prison.
Second Degree Burglary – This charge is a class C felony and is filed when the offender
is armed or pretends to be, and causes injury or threatens harm to another
or others when in a residence. A conviction can include up to 15 years
in state prison.
First Degree Burglary – This is a class B violent felony. It is charged when the crime
occurs in a residence and involves a deadly weapon and injury, or threat
of injury to others. A conviction of this degree could allow the court
to impose a sentence of 25 years in prison.
