Before jumping into the specific penalties for each charge, here is an outline of the various DWI charges that you could be faced with in New York criminal court:

  • DWI (Driving While Intoxicated) - Found with a blood alcohol level of .08% or more while operating a motor vehicle.
  • Aggravated DWI - Found with a .18% BAC level while operating a motor vehicle.
  • DWAI (Driving While Ability Impaired) - Found with a BAC level between .05-.07% so your abilities are slightly impaired while driving a motor vehicle.
  • DWAI Drug - Found driving a motor vehicle while under the influence of drugs.
  • DWAI Combination - Found driving a motor vehicle while under the influence of both alcohol and drugs.
  • Zero Tolerance - This is when a minor, under the age of 21, is found driving while intoxicated with a BAC between .02-.07%.

    • Jail sentence of up to 30 days
    • Fine of $500-$750
    • License revocation for six months

Third Offenses

  • Third DWI / DWAI Drug:
    • ​Jail sentence of up to 7 years
    • Fine of $2,000-$10,000
    • License suspension for 7 years
  • Third Aggravated DWI:
    • Jail sentence of up to 7 years
