Understanding the Zero Tolerance Law

The State of New York has a "Zero Tolerance Law" that provides for penalties to be imposed upon drivers under 21 who are accused of operating any vehicle with a BAC level at 0.02% or higher. The first conviction on such a charge will include a $125 civil penalties, and a license suspension for 6 months, and the second will result in a revocation of a driver's license until the age of 21 is reached.

There are other charges that could be imposed include DWAI (when the BAC is above .05% but less than .08%), or DWI which is the charge when the BAC level is at .08% or higher.
